An interesting ruling was released on March 25, which relates to whether or not insurance companies should be responsible for the costs involved to remove chinese drywall from homes. It is also particularly relavant to us and our clients because the ruling took place right here in Tampa. This case is unique because the insurance policy in question does not contain a “pollution exclusion”. The “pollution exclusion” is what most insurance companies are using as their defense against having to cover the expense of remediating a home with chinese drywall. Although most insurance policies do contain a pollution exclusion, this case in still relevant due to a number of the findings. One which we think could potentially be used in other cases is the use of the definition of “smoke” and how the offgassing of chinese drywall has been determined to fall within the reasonable definition of “smoke” within the insurance policy.
